                   	     ORDINANCE NO. 9743
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING AN ALLEY
                   LOCATED SOUTHWEST OF ROSSVILLE AVENUE,
                   NORTHWEST OF MADISON STREET, MORE PARTICULARLY
                   DESCRIBED HEREIN, UPON CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned an alley located southwest of Rossville Avenue,
         northwest of Madison Street, more particularly described 
herein,
         and as shown on plat attached hereto and made a part hereof by
         reference:
                An alleyway some 25 feet wide, as shown on plat of
                Amended Boyce Addition No 2, as shown by plat of
                record in plat book 5, page 10, R.O.H.C.  To find
                the true point of beginning of said alleyway, start
                on the southwest line of Rossville Avenue some 120
                feet northwest of the intersection of the southwest
                line of Rossville Avenue with the northwest line of
                Madison Street, if extended southwestwardly, said
                point being in the southwest line of Rossville
                Avenue, as now widened, and in the southeast line
                of lot 1, block 10, said Amended Boyce Addition No.
                2, 20 feet southwest of the original southeast
                corner of said lot 1, thence southwest 105 feet
                with the southeast line of said lot 1 to the
                southwest corner thereof, thence northwest 153.8
                feet with the southwest line of said block 10 to
                the true point of beginning, thence southwest some
                25 feet to the southwest line of the said alleyway,
                thence northwest some 147 feet with said southwest
                line, thence southeast some 50 feet to the
                northeast line of said alleyway, thence southeast
                some 89.15 feet with said northeast line to the
                true point of beginning.  Tax Map No. 145M-N-3 and
                6.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                1. Reservation of an easement the width of the
                   right-of-way for South Central Bell for the
                   purpose of operating and maintaining its
                   facilities in said right-of-way.
               
                2. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                3. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
